When a loved one can no longer make informed decisions due to dementia, a serious mental illness, a developmental disability, or a medical condition such as a stroke or brain injury, families may face difficult choices about their care and safety.
In some cases, guardianship and/or conservatorship may be necessary to ensure their well-being. Before this legal step is taken, a formal evaluation is required to assess the person’s ability to manage their personal, medical, and financial affairs.
These evaluations consider the individual’s medical, psychological, and social history, living situation, and support system. It often includes interviews with family and caregivers. The goal is to determine whether guardianship/conservatorship is needed, and if so, to recommend a guardian who can act in the person’s best interest with care and integrity.
We also offer probate mediation for cases where there are significant disagreements regarding guardianship/conservatorship issues and/or estate or inheritance issues.
